These Terms govern your access to and use of Heartsy, including the app and these pages.

By creating an account, signing in, or using Heartsy, you agree to these Terms. If you do not agree, do not use the app. English is the governing language of these Terms.

Agreement

These Terms are an agreement between you and the operator of Heartsy. They apply to everyone who uses the app or these pages.

The service

Heartsy is a private space for two people who are already together. It is not a public community or a way to meet strangers. Features include:

  • Email or Sign in with Apple, and a profile with nickname, birthday, gender, and photo
  • Pairing with an invite code. Before accept, the other person can see your avatar and nickname. After accept, you share one space. Only one active relationship at a time
  • Home, with both avatars, names, days together, a note when one exists, and the latest moment
  • Notes: one short message left for your partner, shown only on home
  • Chat: one conversation between the two of you, with text, one photo, or one location snapshot. Location is not live tracking. There is no voice, read receipt, or message recall
  • Moments: your own posts with text, one photo, or both. You can delete your own posts. There are no likes, comments, or multi-photo posts
  • Us: profile, together date, unbind, safety report, and account deletion

Until you pair, you can only complete your profile and send an invite. We may add, change, suspend, or remove features at any time.

Eligibility and accounts

You must be at least 18 years old to use Heartsy. By using the app, you confirm that you meet this requirement.

You agree that:

  • The information you provide is accurate
  • You will keep your login details secure
  • You are responsible for activity on your account
  • You will not sell, lend, or share your account
  • You will tell us if you think someone used your account without permission

Couple features

You can invite one person with an invite code. Codes can be copied, shared, invalidated, or replaced. Only one active relationship is allowed at a time.

If both of you accept:

  • You share one space. Notes, chat, moments, and home details in that relationship are visible to both of you
  • You are responsible for what you choose to send or post

Unbinding ends that relationship and closes its shared space. Content from the old relationship does not move into a new one. Deleting your account deletes your account; it is not the same as unbinding.

Your content

You keep ownership of the text, photos, notes, and other materials you submit ("User Content").

You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, display, and transmit that content only as needed to operate Heartsy for you and anyone you share with in the app.

You are responsible for your User Content and for having the rights to upload it. Do not submit content that is illegal, infringing, abusive, sexually exploitative, or that includes someone else's personal information without permission.

Acceptable use

You agree not to:

  • Use Heartsy for any illegal or unauthorized purpose
  • Harass, stalk, threaten, or harm another person
  • Impersonate someone else or misrepresent a relationship
  • Attempt to access another account or our systems
  • Interfere with the app or circumvent security
  • Reverse engineer the app except where the law does not allow that restriction

We may remove content, limit features, or close accounts that violate these Terms.

Privacy

Your use of Heartsy is also subject to our Privacy Policy.

Availability

We do not promise that Heartsy will always be available, uninterrupted, or error-free. We may perform maintenance, release updates, or limit access.

Third-party platforms you use to sign in or receive notifications have their own terms, and we are not responsible for them.

Suspension and ending

We may suspend or end your access if:

  • You violate these Terms
  • Your use creates legal or safety risk
  • We are required to do so by law

You may stop using Heartsy at any time and may delete your account in the app. Provisions that should survive, including ownership, disclaimers, and limitation of liability, will survive.

To the maximum extent permitted by law, Heartsy is provided "as is" and "as available," without warranties of any kind.

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages
  • We are not liable for loss of data, profits, or goodwill arising from your use of Heartsy
  • Our total liability for any claim relating to Heartsy will not exceed the amount you paid us for the service in the 12 months before the claim, or USD $50, whichever is greater, unless the law requires otherwise

Some places do not allow certain limits, so parts of this section may not apply to you.

You agree to defend and hold harmless the Heartsy operator from claims arising from your use of the app, your User Content, or your violation of these Terms or the law.

If a part of these Terms cannot be enforced, the rest remains in effect. These Terms are governed by the laws that apply to you, unless another law is required.

Changes

We may revise these Terms. If we make material changes, we may provide notice in the app or on these pages. Continued use after the update means you accept the revised Terms.
